In order to determine if you have a lemon or not, you would have to look at your defects and check to see how often you repaired the defect within a certain period of time within your warranty. If you had many repairs on one defect and still have the defect, you have a lemon. However, if your paint is peeling, the light switch came off when you yanked on it, or your car makes funny noises, but none of these incidences stop you from driving the vehicle, it is not a lemon.
On the other hand, if you have brakes that don’t work, a car tat just won’t go into reverse, you can’t get the vehicle to start on cold mornings or even on hot afternoons, or the car will not go faster than 30 mph instead of the 50 mph it is supposed to go, you may have a lemon. But this is only dependent on whether the manufacturer recalled the vehicle and repaired the defect or not. If the manufacturer did make the attempt to repair the defect, but the defect remained, you have a lemon and can go after the manufacturer for damages.
